Justice-Seeking/Justice-Seeking
Most constitutions plainly have as one of their ends the goal of reducing injustice in the community they constitute. But this is a puzzle. In any community with which we are familiar, now or it the past, it would be naïve to think that preserving things just as they are would be the way to best resist injustice. We are a flawed species, and working towards justice requires change for the better. But how can that be achieved by invoking a source of law that is distinguished by its obduracy to change? That constitutions are in part Justice-Seeking is obvious; but what must we understand about constitutional meaning and practice to explain how a constitution can succeed at Justice-Seeking?
