About Shun:
Shun is Professor of legal philosophy in the Faculty of Law, Waseda University. His main research interest is in the global legal order and the concept of law within it. His recent works include topics of the philosophy of international law, global justice, the rule of law, and legal pluralism. He is the author of Kokusai Ho Tetsugaku no Fukken (Reclaiming Philosophy of International Law; in Japanese) and a contributor to Encyclopedia of Philosophy of Law and Social Philosophy (ed. by Sellers and Kirste).

About this Webinar
This webinar provides space for a discussion on the legitimacy of international law. States and non-state actors acting in violation of international law are often seen as also acting wrongfully. While the prohibition of genocide or torture under international law, for example, undeniably originates in moral condemnation of these acts, moral considerations do not directly translate into law, and these terms must be interpreted within the law.
 
For the tacit assumption that violations of international law are morally blameworthy to be justified, the legitimacy of international law, i.e., there being content-independent reason to obey it, must be vindicated. Apart from the now-dated state consent theory, several grounds have been put forward to this end, though none is without a flaw. An alternative can be found in Fuller’s idea of the internal morality of law, which grounds law’s legitimacy in its respect for agency.
 
The webinar is organised by Essex CAJI and will allow 30 minutes for the presentation, followed by a further 30 minutes for discussion.
